These are the general terms and conditions applicable to the services of The Correspondent B.V., a Netherlands-based legal entity incorporated in Amsterdam, with its registered address at Barentszplein 7, 103 NJ, Amsterdam, The Netherlands. We’ll refer to ourselves as "The Correspondent" or "we".
When becoming a member of The Correspondent B.V., we will be collecting your membership fee either directly by The Correspondent B.V. or through The Correspondent, Inc., a US-based legal entity incorporated in Delaware, with its registered address at Corporation Trust Center, 1209 Orange Street, City of Wilmington, County of New Castle, State of Delaware 19801, USA.
The content which you will receive will be published solely by The Correspondent Media B.V., a Netherlands-based legal entity incorporated in Amsterdam, with its registered address at Barentszplein 7, 103 NJ, Amsterdam, The Netherlands. The Correspondent Media B.V. has full and independent journalistic freedom and publishes content as it deems appropriate. The Correspondent B.V. is not liable for any content published by The Correspondent Media B.V..
These general terms and conditions apply to all the services offered by The Correspondent and to any agreement concluded between The Correspondent and yourself. The Correspondent retains the right, at all times, to change these general terms and conditions. By using the digital services of The Correspondent, you indicate your agreement to the general terms and conditions.
Service
The Correspondent offers high-quality journalism (including, but not exclusively, reports, columns, interviews, etc) via its website (www.thecorrespondent.com - the Website) and other digital and non-digital channels (the Service). The Service is available to everyone who takes out a membership (hereinafter to be referred to the Membership), and those who have already taken out a Membership (hereinafter referred to as a Member or Members). A Member receives unlimited access to the Service. Non-members can only view content if members or correspondents share this with them.
Membership
You can start your Membership via the Website; Membership gives you full access to the Service. You are personally responsible for managing your login details. If you lose your details or suspect that your account has been violated, please let us know immediately. The Correspondent has the right to refuse a request for Membership.
Access code
Once you’ve started your Membership, you can log in with the use of a password of your choice and make full use of the Service. The Membership is intended for personal and non-commercial use. You are therefore not permitted to provide your password to third parties. The Correspondent has the right to cancel a password after it has been sent.
Price and payment
When you apply for a Membership, you shall automatically receive a confirmation by email (check your spam box). The Correspondent has the right to change the price of the Membership, but it will inform members of any price increase and offer the possibility to terminate the membership. Payment must be made via the online payment service. When you apply for Membership, you will be given the option to pay per month or per year. If you pay per month, the monthly amount shall be debited at the rate as it applies at that time. If you pay per year, the annual membership fee shall be debited at the rate as it applies at that time. In the event of late payment, The Correspondent has the right to suspend or cancel the Membership and refuse access to the Service.
Duration and termination
The Membership is entered into for an indefinite period of time. If you pay monthly, you can terminate the Membership at any time; the Membership shall then end on the last day of that monthly period. A monthly period commences on the day you become a member until the same day the following month. If you pay annually, you can terminate your membership at any time after the first year. Any membership fee paid in advance shall be repaid proportionately. The Correspondent has the right to block or terminate your Membership if there is a suspicion you are not complying with this user agreement. Gift memberships and trial memberships are not automatically extended.
Liability
The Correspondent is not liable for any damage you may suffer as a result of the use of the Service, unless this damage was caused by intent, gross negligence or deliberate recklessness on the part of The Correspondent. You acknowledge that The Correspondent is an author's platform which (therefore) contains subjective information. Although The Correspondent endeavours to provide correct and high-quality information, we do not guarantee that the information provided via the Service is correct. The Correspondent is not liable for the consequences of such inaccuracies, should they occur.
Warranty disclaimer
The Correspondent’s website and membership are provided “as is” and “as available” and without warranty of any kind, express or implied.
THE CORRESPONDENT SPECIFICALLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM THE CORRESPONDENT SHALL CREATE ANY WARRANTY.
Privacy
The Correspondent values privacy. We handle personal data confidentially and in accordance with the General Data Protection Regulation. Please refer to the privacy policy of The Correspondent for further information.
License
If you share content via the Service (e.g. in the contributions under an article) you provide The Correspondent an eternal, unconditional license to publish, publish further, multiply, save or use this content, or a part thereof, in any other way for journalistic purposes.
Intellectual Property Rights
All the content and layout (such as texts, photos, images and other creations) of the Service are subject to intellectual and industrial property rights. It is not permitted to make public, multiply, scan or otherwise use the Service, or parts thereof, without first obtaining the advance written permission of The Correspondent. If you wish to copy or purchase an article, please contact us via the contact page.
Use
As a condition for the use of the Service, you agree not to offer information, data or content via The Correspondent that:
a) promotes racism, violence or hate;
b) is false or misleading;
c) breaches intellectual property rights;
d) violates privacy rights;
e) breaches any legislation or regulations;
f) imitates or pretends to have a relationship with a person or entity;
g) enters non-public or secure areas of the Service;
h) sends viruses, worms, junk mail, spam, chain letters, unsolicited offers or advertisements of any nature and for whatever purpose;
i) investigates, scans or tests the vulnerability of the Service or another related system or network, or violates any security or authentication.
The Correspondent retains the right to remove your contributions or to deny you the ability to post a response if your responses do not comply with the aforementioned guidelines or if you obstruct the journalistic process in any way.
Releasing information
The Correspondent has the right at all times to make information public for the purposes of (i) defending itself in legal proceedings, (ii) obeying a court order, (iii) complying with all government legislation, regulations or requests, (iv) protecting national security, defence, public safety and public health and (v) upholding the user agreement.
Complaints procedure
We aim to deliver the best service to our Members. Please let us know if you are not satisfied about anything by sending your complaint, drawn up as comprehensively as possible, via the contact page. We shall respond as soon as possible, though no later than within 14 days of receipt of your complaint.
Miscellaneous
These Terms and the policies referenced in them are the entire agreement between you and The Correspondent with respect to its membership and other services it provides. They supersede all other agreements (whether oral, written, or electronic) between you and The Correspondent with respect to these matters. If any provision of these Terms is found to be invalid under the law, that provision will be limited or eliminated to the minimum extent necessary so that the Terms otherwise will remain in full force and effect and enforceable. The failure of either you or The Correspondent to exercise any right provided for in these Terms in any way will not be deemed a waiver of any other rights.
Disputes
This user agreement is exclusively governed by Dutch law, and disputes shall be submitted to the competent court in Amsterdam, unless this choice of law or court have the result of depriving you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of such choice, would have been applicable.
