Our Terms and Conditions

These are the general terms and conditions applicable to the campaign and website of The Correspondent, Inc., a US-based legal entity incorporated in Delaware, with its registered address at Corporation Trust Center, 1209 Orange Street, City of Wilmington, County of New Castle, State of Delaware 19801, USA. We’ll refer to ourselves as "The Correspondent" or "we".

What happens to my money if I become a member?

We will only charge you if and when we reach our fundraising goal of $2.5 million. We calculate the $2.5 million on the basis of all the money paid and pledged in the context of this campaign, including any commission charged by our payment service providers.

In most cases, we agreed with our payment service providers to hold the money for us until we achieve our goal. If we don’t reach the goal, they'll refund the money to you. In some cases, however, payment providers will transfer the money directly to us shortly after you sign up to become a member. For those situations, if we do not reach our goal of $2.5 million, we will refund the money ourselves (see below for more information).

Here’s what to expect, depending on the payment method you used to become a member:

Using credit cards
When supporting the campaign through credit card, most credit card providers will charge you directly. Some will charge you with a temporary retainer of, for example, $1.

Using iDeal, Bancontact, Google Pay, Apple Pay or Microsoft Pay
When supporting the campaign through one of these payment methods, we’ll immediately collect the amount you pledged. However, this will remain in the custody of Stripe (our payment service provider) until we reach our goal of $2.5 million. If the goal is not reached, Stripe will refund the money you pledged.

Donations by our current Dutch Members
If you are already a member of our Dutch-language platform De Correspondent, you can easily become a member of The Correspondent by donating through our Dutch-language website. If you decide to do so, you give The Correspondent, Inc. permission to have De Correspondent B.V. charge the donation through its already existing payment infrastructure for members. We’ll only charge you if we have reached our goal.

What happens when you reach your goal?

If we reach our fundraising goal, this movement will become more than just a promise: we’ll actually launch The Correspondent, an online platform for unbreaking news. It will take] time to build a team and platform, so please bear with us! As a member, we’ll keep you updated on our progress, and when the platform is launched, you will automatically get a member account. We will also send you details of our privacy statement. If you log in at The Correspondent, you will also be asked to agree to our terms and conditions. (The terms and conditions you are reading now are just for the membership campaign. Those for The Correspondent platform haven't been published yet).

What happens if you don’t reach your funding goal?

If we don’t reach our goal of $2.5 million by the end of the membership campaign on December 14, we will refund the membership contributions paid to us during the campaign. We will do so as quickly as our payment service providers allow us to.

To the fullest extent permitted by law, in no event will The Correspondent, its directors, employees, partners, suppliers, or content providers be liable for any indirect, incidental, punitive, consequential, special, or exemplary damages of any kind incurred as a result of this campaign*, including but not limited to damages due to the failure of any third-party payment provider to refund donations, unless the damage is the result of intent or recklessness on the part of The Correspondent. In no event shall The Correspondent’s liability for direct damages be in excess of the amount of your donation.

What do I get for my donation?

How is ‘Win a Portrait’ organized?

Members can become an ambassador for The Correspondent by recruiting new members. If you recruit a new member, you become eligible to win an avatar created by The Correspondent’s illustrator Cléa Dieudonné. After you’ve become a member you will get the opportunity to grab a personal sharing link. You can send this link to others who you think might be interested in The Correspondent. We track who became a member through your link. If one or more new members sign up through your link and if you decide to participate, you are in the running for your own The Correspondent-style avatar. At the end of each week, a winner will be selected based on their effectiveness in recruiting new members as well as the originality of their recruiting efforts.

Which law applies?

If you become a member of The Correspondent, any obligation arising out of or in connection with this membership or the donation provided by you is governed exclusively by Dutch law. The District Court of Amsterdam, the Netherlands, has exclusive jurisdiction to settle all disputes arising out of or in connection with this membership or the donation provided by you, including disputes concerning the existence and validity of a donation and any (other) non-contractual obligations. Though if you have an issue with us, we encourage you to contact us directly at hello@thecorrespondent.com before resorting to the courts so that we can try to work out any concerns in cooperation with you.

Warranty disclaimer

The Correspondent’s membership campaign is provided “as is” and “as available” and without warranty of any kind, express or implied.



These Terms and the policies referenced in them are the entire agreement between you and The Correspondent with respect to donations and membership. They supersede all other agreements (whether oral, written, or electronic) between you and The Correspondent with respect to these matters. If any provision of these Terms is found to be invalid under the law, that provision will be limited or eliminated to the minimum extent necessary so that the Terms otherwise will remain in full force and effect and enforceable. The failure of either you or The Correspondent to exercise any right provided for in these Terms in any way won’t be deemed a waiver of any other rights.
